NOTICE OF TRUSTEE’S SALE
OF IMPROVED REAL ESTATE

In execution of a deed of trust dated September 28, 2011, recorded in the Office of the Clerk of the Circuit Court of Richmond County, Virginia in Deed Book 289, at Page 632, conveying certain real estate described therein to Patience Ann Alexander, Trustee, default having been made in the debt secured by the deed of trust, and being requested so to do by the noteholder, James C. Breeden, Substitute Trustee, having been appointed substitute trustee by instrument of substitution dated October 18, 2017 and recorded in the Clerk’s Office aforesaid as Instrument #170000833 will offer for sale at public auction on the front steps of the Richmond County Courthouse in Warsaw, Virginia on March 10, 2018 at 11:00 a.m., the improved real estate lying in the County of Richmond, Virginia and more particularly described as follows:

All that certain lot or parcel of land, together with all appurtenances thereunto belonging, situate in Farnham Magisterial District, Richmond County, Virginia, containing 0.58 acres, more or less, as shown on a plat of survey, made by Sterlin L. Headley C.L.S., dated September 27, 1994, recorded in Deed Book 164, at Page 8 in the Circuit Court Clerk’s Office of Richmond County, Virginia.
The sale is subject to all applicable liens of record, including other deeds of trust, which have priority over the aforesaid deed of trust, and further subject to conditions, covenants, restrictions, reservations, easements, rights of way and other matters of record applicable to the property, and the real estate taxes from the date of sale. The property and all improvements located thereon, if any, will be sold in their “AS IS” condition without warranty of any kind. Purchaser shall be solely responsible for obtaining possession of the property from the occupants. Neither the Substitute Trustee nor the holder of the note secured by the deed of trust will deliver possession of the property to the successful bidder.
TERMS OF SALE: All cash.
A deposit of 10% of the sale price by cash or bank cashier’s check, payable to the Trustee will be required of the successful bidder at the time of sale, with the balance due within 30 days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee’s compensation authorized by the deed of trust and the law in such cases.
The purchaser at the sale will be required to pay all closing costs, except the grantor tax. Real estate taxes will be prorated as of the date of closing. Title will be conveyed by Special Warranty.
The Trustee reserves the right to reject any and all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.
